Declaration Trust

If the name on the policy is not the person who should benefit, write that down properly.

A written statement of who truly benefits when the legal owner of a policy is holding it for someone else.

When a declaration comes up

Sometimes the person who owns the policy is not the person the money is meant for. A company might hold a policy in the context of a shareholder arrangement. A parent might own a policy for a child. A declaration of trust records the beneficial interest so it is not left to memory.

  • It does not, by itself, create the insurance cover. The policy still has to be issued and kept in force.
  • It is not a will, and it does not override faraid or the Distribution Act by wishful wording.
  • The insurer may still pay according to the policy and the law. The declaration is about the relationship behind the policy, and it needs to be consistent with the contract.

How we handle it

We map who pays, who is insured, who is named, and who should benefit. If a declaration is appropriate, we say so and point you to the right professional to draft it. We do not sell a template as legal advice.
